Terms of Use for NYFA Google Apps for Education

Service Description
NYFA Google Apps for Education is a set of communications and collaboration applications hosted by Google Inc. on behalf of New York Film Academy. NYFA Google Apps for Education is offered by Google to NYFA in accordance with a specially negotiated end-user license agreement designed to protect the privacy and security of information owned by NYFA and the members of its community, guaranteeing that Google will not access or re-use information stored in these applications for its own, commercial purposes.

General Terms
As of January 2011, NYFA began to offer Google accounts to NYFA full-time and part-time students, faculty, and staff. This Terms of Use document explains the terms of service and user obligations when utilizing NYFA Google Apps for Education. NYFA expects that NYFA Google Apps for Education users for all service offerings will employ reasonable and appropriate safeguards concerning the information they transmit and store.

In all instances, this Terms of Use augments and reinforces (1) all federal, New York State, California, Florida local, and other applicable law; (2) all NYFA rules and policies; and (3) all applicable contracts and licenses. Violations could result in loss of privileges or disciplinary action. Sending abusive or threatening communications via email or other communications means can result in criminal charges against the sender.

NYFA may add or delete Google service offerings from time to time and reserves the right to change, at any time, at its sole discretion, the provisions of the service and these Terms of Use.

In order to use Google Apps for Education as provided to NYFA, all users must be aware of, agree to, and adhere to the following:

  1. Anyone in the NYFA community utilizing NYFA Google Apps for Education services must agree and adhere to the Google Terms of Service. In all cases, Google’s privacy policies govern.
  2. Anyone in the NYFA community utilizing NYFA Google Apps for Education services must be aware that their data may be stored in datacenters outside the borders of the United States.
  3. Anyone in the NYFA community utilizing NYFA Google Apps for Education services acknowledges that NYFA has the authority to monitor, use, or disclose their data under appropriate circumstances, and that Google provides NYFA the ability to do so.
  4. The NYFA IT Helpdesk will provide general support for NYFA Email powered by Google and substantive support to the best of its ability on the core set of NYFA Google Apps for Education, while offering limited, best-effort help and advice on the large set of linked commercial Google applications.
  5. Anyone in the NYFA community utilizing NYFA Google Apps for Education services must acknowledge that Google can terminate their account if they fail to abide by the Google Terms of Service.
  6. Any data stored in Google Apps for Education services through NYFA will be deleted upon termination of employment or student status.
  7. Nothing about the implementation of NYFA Google Apps for Education changes NYFA’s policies or guidelines for appropriate handling of data, whether transmitted, shared, or stored.
